https://www.proninpartners.com/ (hereinafter referred to as the "Site") is managed
by the Law Firm "Pronin and Partners" (hereinafter referred to as the
"Site Administration"), which is registered and operates in accordance
with the requirements of the legislation of Ukraine. The Site may also be managed by other authorized persons.
The Privacy and Personal Data Protection Policy (hereinafter referred to as the “Privacy Policy”) applies to all information that the Site Administration, using the Site, receives about the User during the latter’s use of the Site and receipt of legal assistance and/or other services.
Please note that this Privacy Policy has been prepared taking into account the latest changes in the legislation regulating the protection of personal data, namely, taking into account the requirements of the General Data Protection Regulation (EU Regulation No. 2016/679 of 27.04.2016 or GDPR).
1. DEFINITION OF TERMS
1.1. This clause defines the interpretation of the following
terms and definitions used in this Agreement.
1.1.1.
“Site” – a web page located at the link:
https://www.proninpartners.com/ and managed by the Site Administration.
The term “Site” includes links to other open web resources,
subdomains of https://www.proninpartners.com/.
1.1.2. “User”
– any individual who has access to the Site, who uses
the Site via the Internet.
1.1.3. “Personal data”
– any information that directly or indirectly relates to a specific individual
(personal data subject).
1.1.4. "Processing of personal data" - any action (operation) or set of actions (operations) performed with the use of automation tools
or without the use of such tools with personal data, including
collection, recording, systematization, accumulation, storage, clarification
(update, change), extraction, use, transfer (distribution,
provision, access), blocking, deletion, destruction of personal
data.
1.1.5. "Confidentiality of personal data" -
mandatory for compliance by the administration or another person who
has access to personal data, the requirement not to allow their
distribution without the consent of the personal data subject or the presence of another
legal basis.
1.1.6. "Cookies" - a small piece of data sent by a web server and stored on the user's computer, which is sent by a web client or web browser to the web server in an HTTP request when trying to open a page of the corresponding site.
1.1.7. "IP address" - a unique network address of a node in a computer network, built using the IP protocol, which allows to identify the location and other information about the User.
1.2. All definitions and terms not defined in this
section shall be interpreted in the meaning specified by the current legislation
of Ukraine, and in the absence of such a definition - in their usual
meaning.
2. GENERAL PROVISIONS
2.1. The User's use of this Site means the User's automatic and
full consent to this Privacy Policy and the terms
of the User's personal data processing.
2.2. If
the User does not agree with the terms of the Privacy Policy, the latter
is obliged to stop using the Site and immediately leave
it.
2.3. The current Privacy Policy applies to
the Site or another website, a link to which is posted on the Site and
which is controlled by the Site Administration.
2.4. The Site Administration
does not control and is not responsible for third-party sites,
to which the User can access via links available on
the Site.
2.5. The Site Administration does not verify the reliability of the personal data provided by the User.
2.6.
The Site Administration is the controller of personal data of authorized
Users of the Site. The controller of personal data is the person who
determines why (for what purpose) and how to collect personal
data.
3. AGE RESTRICTIONS
3.1. By placing an order for Legal Assistance on the Site,
the User confirms that he has reached the appropriate age, which allows
him to independently conclude the relevant agreements.
3.2. In the event that
the Site Administration asks the User to consent to the processing of
personal data, he can do so independently. By registering on the Site, the User confirms that he has reached the appropriate age, which allows him to independently consent to the processing of personal data.
3.3. If the User has doubts as to whether he can independently consent to the processing of personal data, he must contact the authorized body for the protection of personal data.
3.4. The Site Administration may request the User to provide additional documents or undergo additional procedures in order to verify that he has the right to independently consent to the processing of personal data. If the Site Administration has reasonable doubts as to the age of the User, it may also contact his parents or guardians in order to obtain consent or approval for the Processing of the User's personal data if he has not reached the appropriate age. For the period
of clarifying the circumstances or obtaining consent or approval from parents
or guardians, the Site Administration may restrict the processing of the User's data
by temporarily suspending the provision of Legal Assistance.
4. SUBJECT OF THE PRIVACY POLICY
4.1. The current Privacy Policy establishes the obligations of the Site Administration to non-disclosure and ensure the protection of personal data, which the User must provide to the Site Administration upon request when placing an order for Legal Assistance on the Site.
4.2. Personal data,
permitted for processing within the framework of this Privacy Policy,
are provided by the User by filling out certain forms on the Site or in
any format and may include the following information:
4.2.1.
Full name of the User;
4.2.2. contact phone number
of the User;
4.2.3. e-mail address (e-mail)
of the User or login in the Telegram application;
4.2.4. other
confidential data about the User's identity or contacts
of the User;
4.2.5. Information from the DIYA portal (if integration with the specified service is connected).
4.3. In addition to the data provided for
in clause 4.2. of this Privacy Policy, the Site Administration reserves
the right to automatically collect the following data during the User's browsing of the Site or
its individual pages:
4.3.1.
IP address of the User's electronic computing device (computer, phone,
tablet, etc.);
4.3.2. information about
Cookies-data stored in the User's browser;
4.3.3.
information about the User's electronic computing devices (computers, phones, tablets, etc.);
4.3.4. information about the User's browser, including the name, browser version, etc.;
4.3.5.
time of access to the Site;
4.3.6. addresses of the Site pages viewed by the User;
4.3.7. addresses of previous pages from which access to the Site was obtained.
4.4. Disabling the Cookie collection function by the User may result in the inability to access parts of the Site.
4.5. The Site collects confidential data provided for in clauses 4.2.-4.3. of this Privacy Policy, including for the purpose of identifying and resolving technical problems with the Site, for controlling the load on the Site and for conducting statistical calculations of the effectiveness of the Site's advertising campaigns.
4.6.
Any other personal or confidential information not specified above shall be securely stored and not distributed, except for the cases provided for in clauses 7.2. – 7.4. of this Privacy Policy.
5. PURPOSES OF COLLECTING USER PERSONAL INFORMATION
5.1. The Site Administration may
use the User's personal data for the purposes of:
5.1.1. Identification of the User,
registered on the Site, for joining the public
offer agreement remotely;
5.1.2. Providing the User
with legal assistance and/or other services;
5.1.3. Establishing feedback with the User, including the direction of messages, requests related to the use of the Site and the provision of Legal assistance;
5.1.4. Determining the location of the User to ensure security and prevent fraud;
5.1.5.
Confirming the authenticity and completeness of the Personal Data provided by the User;
5.1.6. Notifying the User of the Site about the status of the order for the provision of Legal assistance;
5.1.7. Providing the User with effective customer and technical support in case of problems related to the use of the Site;
5.1.8.
Providing the User, with his consent, with updates, special offers, information on prices, news and other information on behalf of the Site Administration.
5.1.9. Carrying out advertising activities with the consent of the User.
5.2. The User's personal data may
be used for other purposes not provided for by the Privacy Policy
that fall within the scope of the Site Administration.
6. DATA STORAGE
6.1. The Site Administration stores the User's Personal Data
only as long as it is needed by him or the Site Administration,
for the purpose specified in this Privacy Policy. The latter
also applies to any other third party performing certain actions on behalf of
the Site Administration. If the Site Administration does
not need certain data about the User and does not need to
store them in accordance with the requirements of the law, it will delete them or
store them in a way that makes it impossible to identify
the User.
7. METHODS, PROCEDURE AND TERMS OF PROCESSING PERSONAL INFORMATION
7.1. The processing of the User's personal data is carried out without
time limits, by any lawful means, including in
personal data information systems using means of
automation or without using such means.
7.2.
By staying on the Site, the User automatically agrees
that the Site Administration has the right to transfer personal data
to third parties, solely for the purpose of fulfilling the User's order,
placed on the Site.
7.3. The User agrees that
the Site Administration has the right to transfer personal data
to employees of the Joint Stock Company, authorized persons, third parties, in particular,
courier services, postal organizations, telecommunications operators and others, solely for the purpose of fulfilling the User's order
placed on the Site, including payment for the provision of
Legal assistance.
7.4. The User's personal data may
be transferred to authorized state and judicial bodies only if
there are legal grounds and a corresponding requirement.
7.5. In case of
loss or disclosure of personal data, the Site Administration
shall inform the User about the loss or disclosure of personal data
by any methods available to it.
7.6. The Site Administration
takes the necessary organizational and technical measures to protect
personal information from unauthorized or accidental access,
destruction, distortion, blocking, copying, distribution, as well as
from other illegal actions of third parties.
7.7. The Site Administration
together with the User takes all necessary measures to
prevent losses or other negative consequences caused
by the loss or disclosure of the User's personal data.
8. OBLIGATIONS OF THE SITE ADMINISTRATION TO PROTECT PERSONAL DATA
8.1.1. Use any information received exclusively for
the purposes specified in
8.1.2. Ensure the confidentiality and
security of the User's personal data.
8.1.3. Do not
disclose without the prior written consent of the User, and also do not
sell, exchange, publish or disclose in other
possible ways the User's personal data transmitted, except for
clauses 7.2. - 7.4. of this Privacy Policy.
8.1.4.
Take precautions to protect the confidentiality of the User's personal data in accordance with the procedure usually used to protect this type of information in existing business transactions.
8.1.5. Block personal data relating to the relevant User from the moment of the User's request or request, or from the authorized body for the protection of the rights of personal data subjects for the period of verification, in case of detection of inaccurate personal data or illegal actions.
9. LIABILITY OF THE PARTIES
9.1. In case of failure to fulfill the obligations specified in this Privacy Policy, the Site Administration and/or authorized persons shall be liable for damages incurred by the User in connection with the misuse of personal data in accordance with the current legislation, except for the cases provided for in clauses 7.2. – 7.4. and 9.2. of this Privacy Policy.
9.2. In case of loss or disclosure of the User's Personal Information, the Site Administration shall not be liable if this information:
9.2.1.
Became or was public at the time of loss or disclosure;
9.2.2.
Was received from a third party before its receipt by the Site Administration;
9.2.3. Was disclosed with the consent of the User.
9.3. The Site Administration in all respects not provided for in clause 9.2. is liable in accordance with the current legislation.
10. DISPUTE RESOLUTION PROCEDURE
10.1. The User and the Site Administration shall resolve all disputes and
disagreements arising from the relations covered by this
Privacy Policy through negotiations.
10.2. In the event of
failure to reach an agreement, the dispute will be referred for consideration to the judicial
authorities, in accordance with the current procedural legislation.
11. ADDITIONAL TERMS
11.1. The Site Administration has the right to make changes to the current
Privacy Policy without the consent and notification of the User.
11.2.
The new Privacy Policy shall enter into force from the moment of its posting on the Site, unless otherwise provided by the new version of the Privacy Policy.

11.4. The current Privacy Policy complies with the requirements of the legislation of Ukraine on the protection of personal data and contains detailed information on the data that is collected, the purposes, methods of their collection, processing, use and protection.
11.5. Note for Users from the European Union:
the current Privacy Policy has been prepared to fulfill the obligations stipulated by the General Data Protection Regulation (EU Regulation No. 2016/679 of 27.04.2016 or GDPR - General
Data Protection Regulation).
11.6. All suggestions or questions
